1. Overview of Our Services

AviHire is an online job platform designed for the aviation industry, connecting verified aviation professionals (such as pilots, A&P mechanics, and dispatchers) with employers and recruiters. We provide:

• FAA credential verification (without storing your certificate numbers)
• Candidate and company accounts
• Job posting and application functionality
• Job credit purchasing and featured listings via Stripe
• Automated notifications through Postmark or Azure

2. Eligibility

To use AviHire, you must:

• Be at least 18 years old
• Have the legal capacity to enter into binding agreements
• Use the Platform in compliance with all applicable laws and regulations

Employers and companies represent that they are authorized to post jobs on behalf of their organizations.

3. Account Registration

3.1 Candidate Accounts

Candidates must provide accurate personal information, including full name (as on FAA certificate), email address, and profession. FAA credential verification is required for access to certain features.

3.2 Company Accounts

Companies must provide valid business information such as company name, contact person, address, and billing details.

3.3 Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Promptly notifying AviHire if you suspect unauthorized access

AviHire reserves the right to suspend or delete accounts that provide false, misleading, or incomplete information.

4. FAA Verification

When you register as a Candidate:

• We verify your name, date of birth, and certificate type against our FAA personnel database (via Firebase).
• If your details match, you are automatically verified.
• If not, your account will be marked as "Pending Manual Review," and our admin team may contact you for confirmation.
• We do not permanently store FAA certificate numbers or copies of FAA documents.

5. Job Postings and Applications

5.1 Employers

Employers can:

• Create and manage job listings
• Purchase job credits or featured upgrades via Stripe
• View applications submitted internally through AviHire

Each job credit is valid for one job post, expiring 30 days after publication. Unused credits expire six (6) months after purchase and are non-refundable.

5.2 Candidates

Candidates may:

• Search and apply for aviation-related jobs
• Save or track applications in their dashboard
• Receive job alerts and updates

AviHire is not a recruiting agency and does not guarantee employment or hiring outcomes.

6. Payments and Pricing

• Payments for job credits, featured posts, and banners are processed securely through Stripe.
• Prices are listed in U.S. Dollars (USD) and are subject to change.
• All payments are final and non-refundable, except where required by law.
• Companies must use purchased credits within the validity period stated at checkout.
• If a payment fails or is disputed, AviHire may suspend related job listings or features until resolved.

7. Featured Jobs and Banners

Employers can purchase:

• Featured Job Upgrades ($250) for increased visibility
• Banner Ads ($600) for promotional placement (60-day duration)

AviHire reserves the right to reject or remove ads or featured listings containing:

• Misleading or false information
• Inappropriate or discriminatory content
• Links to external sites unrelated to aviation recruitment

8. Prohibited Activities

You agree not to:

• Provide false, misleading, or fraudulent information
• Impersonate another individual or organization
• Post jobs that violate labor laws or promote illegal activity
• Attempt to hack, scrape, or reverse engineer any part of the Platform
• Send spam, phishing, or unsolicited communications
• Interfere with other users' experience or site functionality

Violation of these terms may result in immediate account suspension or legal action.

9. Intellectual Property

All content, branding, and design elements on AviHire—including text, graphics, logos, and software—are the property of AviHire, LLC (United States) and protected by copyright and trademark laws. You may not copy, modify, or redistribute AviHire's materials without written permission.

Employers and candidates retain ownership of any content they upload (e.g., job descriptions, resumes), but grant AviHire a limited license to display it within the platform.

10. Email and Notifications

By using AviHire, you agree to receive:

• Service-related emails (e.g., verification updates, application confirmations)
• Job or account notifications related to your use of the platform

You can opt out of marketing emails at any time via unsubscribe links. All transactional emails are securely handled through Postmark or Azure Communication Services.

11. Disclaimer of Warranties

AviHire provides the platform "as is" and "as available." We do not guarantee:

• Continuous or error-free operation
• Employment results or hiring outcomes
• The accuracy of information provided by candidates or employers

Use of the platform is at your own risk. To the fullest extent permitted by law, AviHire disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose.

12. Limitation of Liability

To the maximum extent permitted by law, AviHire and its affiliates shall not be liable for:

• Any indirect, incidental, or consequential damages
• Lost profits, data loss, or business interruption
• Errors, omissions, or unauthorized access to data

AviHire's total cumulative liability for any claim shall not exceed the amount paid (if any) for the related service.

13. Indemnification

You agree to indemnify and hold harmless AviHire, its officers, employees, and partners from any claims, liabilities, or expenses arising out of:

• Your use of the Platform
• Your uploaded or posted content
• Violation of these Terms or applicable laws

14. Account Termination

You may delete your account at any time by contacting support@avihire.com. AviHire may suspend or terminate your account if:

• You violate these Terms
• Provide fraudulent or illegal information
• Abuse the platform or its users

Upon termination, access to all platform features and data may be revoked.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States, specifically the State of Delaware, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved through:

• Good-faith negotiation, followed by
• Binding arbitration under the rules of the American Arbitration Association (AAA), unless prohibited by law.

Venue shall be in the State of Delaware, USA.

16. Changes to the Terms

AviHire may update these Terms periodically. The latest version will always be posted on our website. By continuing to use AviHire after changes are posted, you agree to the updated Terms.
